Requirements Under Article 147
To qualify, the inmate must meet all of the following:
- Be in the medium-security phase.
- Have served at least one third of the sentence.
- Have no outstanding warrants or judicial orders.
- Have no record of escape or attempted escape during the process or sentence execution.
- Have served 70% of the sentence if convicted by Specialized Circuit Criminal Courts.
- Have worked, studied, or taught during incarceration and demonstrated good conduct, certified by the Disciplinary Council.
Loss and Suspension of the Permit
- Temporary suspension (up to 6 months): for misconduct or late return.
- Permanent revocation: for repeated serious infractions, new crimes, or special police offenses.
Who Can Apply?
The petition at the prison’s legal office may be filed by:
- The inmate.
- Family members.
- The defense attorney.
- A Human Rights consul.
Processing Time
Evaluation and approval take 4 to 5 months, due to document verification and requirement checks.
