Cruise and Passenger Shipping Liability Regulations

Internationally and in Colombia, there are specific regulations governing liability in cruise ships and maritime passenger transportation. Some of these regulations are:

Internationally

  • International Convention for the Safety of Life at Sea (SOLAS): This convention establishes safety standards for the construction, equipment and operation of ships. In Colombia

In Colombia, regulations on liability in the maritime transportation of passengers can be found in several laws and decrees. Some of the relevant regulations include:

  • Law 1 of 1991 (Code of Commerce): Contains provisions on the contract of carriage by sea and the liability of carriers.
  • Decree 1079 of 2015 (Sole Regulatory Decree of the Transportation Sector): contains provisions on the maritime transportation of passengers, including aspects such as safety, requirements for the provision of services and liability.
  • Resolution 1937 of 2015 (Ministry of Transportation): Regulates the liability of maritime passenger transport operators in Colombia.
  • Resolution 315 of 2016 (Ministry of Transportation): establishes the requirements and procedures for the provision of maritime passenger transportation services.
