Non-Lucrative Residence Procedure for Spain

In this article, we will explain everything you need to know if you want to obtain a non-lucrative residence visa for Spain. The non-lucrative residence visa allows Colombians or foreigners residing in Colombia, as the name suggests, to have their residence in Spain without engaging in any work or lucrative activity in this country. The essential point is to understand that you must have sufficient economic means to live in that country during the validity of the visa.

Who can apply for the non-lucrative residence visa for Spain?

Any Colombian citizen or foreigner residing in Colombia can apply, as long as they demonstrate sufficient economic resources (later we will explain how to do this).

Requirements

1. National visa application form. Submit the original and two (2) copies. A photograph on a white background must be affixed to each form. Don’t forget to sign it.

2. EX – 01 application form. Don’t forget to sign it.

3. Form 790 (code 052). Don’t forget to sign it.

4. Original deposit of the initial residence authorization fee. If you are not a Colombian national, you must also provide the original payment receipt for the visa fee, unless you are exempt.

5. Passport with a minimum validity of one (1) year. Submit the original and one (1) copy of the main page.

6. Criminal record certificate from the last five (5) years apostilled for immigration purposes. The certificate is issued by the National Police and must indicate that you have no criminal record. The apostille is processed on the website of the Ministry of Foreign Affairs of Colombia.

7. Medical certificate issued in Colombia. It must certify that you do not suffer from any diseases that may have serious public health implications, as outlined in the 2005 international regulation.

8. Proof of economic resources. In addition to proving the required amount based on the requested duration of residence, you must:

  • Specify the source of these funds.
  • Provide bank statements for the last year. You can submit a bank certification for this purpose.

9. Apostilled civil registry if applying with family members.

  • Civil registry of marriage if applying for a visa with a spouse.
  • Civil registry of birth if applying for a visa with children.

10. Proof of housing in Spain. This can be demonstrated with a copy of the lease agreement or property deed, or a notarial act from the person with whom you will reside in Spain.

11. Certificate of international health insurance policy. It must cover medical assistance in Spain for the first year and include repatriation expenses to Colombia for an amount of €30,000.

12. Foreign residence permit. If you are not a Colombian national, you must provide the foreign residence permit issued by the Colombian Government.

Duration of the procedure

The duration of the procedure is approximately four (4) weeks. This period may vary depending on the Subdelegation of the Spanish Government responsible for processing the application directly in Spain.

Duration of residence

This visa allows you to initially reside for one (1) year in Spain. After this year, you can extend this visa for two (2) more years. Keep in mind that the time will depend entirely on the economic resources you have available.

Costs (how payments are made)

First, we want to clarify that two payments must be made; the first refers to the visa fee and the second refers to the residence authorization fee.

The deposit of the fees is made at any BBVA branch in Account No. 171-015365, in the name of the Consulate General of Spain in Bogotá.

The fees for the year 2021 are:

Step by step procedure

Can you apply online?

No. The procedure must be done in person at the Consulate General of Spain in Bogotá. However, you must request an appointment. Click here to request an appointment

Can the procedure be carried out from Colombia?

Yes.

Is it necessary to reside in Spain beforehand to make the application?

No.

How is the documentation submitted?

All documentation must be submitted in original and copy in separate groups, as the originals will be returned to you.

Additionally, the payment receipt for the initial temporary residence authorization fee made at BBVA must be the original.

Keep in mind that the criminal record certificate and civil registries (if you need to prove kinship) must be apostilled. The apostille procedure is done online on the website of the Ministry of Foreign Affairs of Colombia.

How is economic capacity demonstrated? and what minimum amounts must be reflected in bank statements for periods of stay of 6 months, 1 year, or more?

Without diminishing the importance of the other requirements, it can be said that this is the most important for obtaining the non-lucrative residence visa. As we explained earlier, it is necessary for you to demonstrate sufficient resources to support yourself and your family.

This amount is calculated based on the IPREM index, which for the year 2021 is €564.90 monthly. Therefore, if you apply for residence individually, you must demonstrate that you have at least 400% of this indicator monthly. If applying with your family group, you need to demonstrate an additional 100% for each member.

First, it is necessary to define how long you will reside in Spain because you must prove that you have the specified amount according to this period. Then, calculate the formula based on the number of people you will be responsible for.

For example, if you are applying for residence for six (6) months, you will need to demonstrate that you have €13,557.60 at the time of your appointment at the Consulate. If you are applying for a visa for one (1) year, you must prove €27,115.20. Now, if you have, for example, two additional people under your care, you will need to prove €20,336.40 and €40,672.80 respectively.

Can you work in Spain with the non-lucrative residence?

During the first year, you will not be able to work with the non-lucrative residence; starting from the second year, you can apply for a work permit.
