Copyright through licensing to third parties

Derechos de autor mediante la concesión de licencias a terceros

Copyright licensing to third parties refers to the act in which the copyright holder grants another person or entity the right to use, reproduce, distribute or perform other actions with a copyrighted work, all under certain conditions and terms set forth in the license agreement.

In Colombia, there are different types of copyright licenses, some of the most common are:

  1. Recognition license: This license allows any exploitation of the work, including a commercial purpose, as well as the creation of derivative works, the distribution of which is also permitted without any restriction, with the sole condition that express reference is made to the author, i.e., that his name appears in any use or act of exploitation made of the work.
  2. Non-commercial recognition license: allows the generation of derivative works as long as no commercial use is made of them. The original work may not be used for commercial purposes.
  3. Attribution license without derivative work: This license allows the commercial use of the work, but not the generation of derivative works, i.e., the work can only be used in its original format and cannot be transformed.
  4. Non-commercial acknowledgment license without derivative work: This license does not allow the generation of derivative works or commercial use of the original work, i.e., only non-commercial uses and purposes are possible.

The existence and granting of copyright licenses are of great importance, since they allow the circulation, dissemination and legal exploitation of copyrighted works. Through licensing, copyright holders can control how their work is used, obtain economic benefits from its use and promote its dissemination.

In addition, licenses are essential to facilitate access and availability of content to the general public. For example, licenses may allow users to use music, images, books or other types of works in their projects, research, publications, artistic productions, among others, without infringing copyright.

Licenses are also essential in the creative and cultural industry, as they allow creators and artists to collaborate with other companies or entities to bring their works to different markets, increase their visibility and generate income for their creations.

In summary, copyright licenses are an essential tool for protecting the interests of rights holders, promoting the dissemination and legal exploitation of works and facilitating access to and use of creative content by the general public.
